Terms of Use

Photodrift is a small utility that helps you clean up your iPhone photo library. These terms exist mostly to be clear about one thing: Photodrift can delete photos, and you are responsible for your own backups.

Acceptance

By installing or using Photodrift, you agree to these terms and to Apple's Licensed Application End User License Agreement (the "Standard EULA"), which applies to every app distributed through the App Store. Where these terms and the Standard EULA overlap, the Standard EULA controls.

Provided as-is

Photodrift is provided "as is" and "as available" without warranty of any kind, express or implied — including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any detected duplicate, blurry, or screenshot result will be accurate for every photo in your library.

Photo deletion

Photodrift never bypasses iOS. Every deletion you confirm in the app is routed through Apple's PhotoKit, which moves the photos to Photos › Recently Deleted. Items remain in Recently Deleted for approximately 30 days, during which you can restore them from the Photos app on any of your devices.

You are responsible for your own backups (iCloud Photos, a computer backup, or another service). To the extent permitted by law, we are not liable for data loss, whether the cause is a Photodrift bug, iOS behavior, user action, or anything else. Permanent loss outside the Recently Deleted window is your responsibility to prevent.

Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to Photodrift is limited to the amount you actually paid for the app (which, depending on whether you purchased Photodrift Pro, is typically between $0 and $9.99 USD). We are not liable for any indirect, incidental, special, consequential, or punitive damages.

Privacy

Photodrift does not collect data about you or your photos. See the Privacy Policy for the full picture.

Changes to these terms

If we change anything material, we'll update this page and change the "Last updated" date at the top. Continued use of the app after a change constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute that is not subject to binding arbitration under the Standard EULA shall be brought in the courts of Ontario.
